Johan Skog has published article on dispute finance

Kapatens partner Johan Skog and Mannheimer Swartling partner Alexander Foerster have published an article on costs issues in arbitrations seated in Sweden involving dispute financing. The article provides a broad review of the costs regulation, including the rules of the Arbitration Institute of the Stockholm Chamber of Commerce, and how questions relating to the increasing use of dispute financing may be addressed and solved. Such issues include a funded party’s claim for costs, any potential adverse costs liability for a funder and the impact of funding on any decision on security for costs. The print version is published in Issue 4/2020 of the German Arbitration Journal (Schieds VZ) and the article will also be available online via Kluwer Arbitration.
