We are a strong advocate for access-to-justice. Today, it does require considerable time, commitment and money to safeguard your right against an opposite party with financial resources. This is something that large companies, authorities and governments take advantage of in order to escape liability. Most of our investments will create balance of power and thus level the playing field.
Disputes and special situations often involve feelings of resentment among the parties involved. We look at each investment opportunity with a professional and analytic approach and will remain objective throughout the term of the investment. We will never fund a case without strong merits.
Sometimes an investment by us is not the best solution for you. If this is our conclusion after reviewing your case or special situation, we will guide you to what we think is a better alternative. We believe that being honest, flexible and helpful will benefit all parties involved in the long perspective.
Our investors are committed in an evergreen structure. We will thus never discontinue the funding of a case just because we need to close any fund. Our investors understand that some of the cases will take time, a lot of time.

Johan Skog focuses on Kapatens’ dispute finance solutions. He was previously a litigator in Mannheimer Swartling’s dispute resolution practice group, acting as counsel in high-value and complex commercial disputes before state courts and arbitral tribunals (ad hoc arbitrations as well as under various institutional rules such as the SCC and ICC). He started his career as an associate at White & Case and as a law clerk at the Stockholm District Court.

Mats Emthén is a well-known insolvency lawyer and entrepreneur with a long career from banks and law firms. He has more than 35 years of experience from acting as court-appointed administrator in bankruptcies, company reorganisations and solvent liquidations. He also has extensive experience in dispute resolution. He is often engaged in special situations, especially when investors, banks, other law firms and auditors need assistance in order to save financial values for their clients. Some of the well-known cases from recent years are Skyways and City Airlines (the second largest airline in Sweden), JB Education (one of the largest private schools in Sweden), and the successful reorganisation of the retail group RNB (with operations in Sweden, Norway, Finland and Estonia). After founding and running Carler Law Firm for 20 years, he now runs the law firm Emthén & Co since 2022.

Björn Sahlström is an entrepreneur and investor who has founded companies in the US, UK and Sweden within investment management and energy. As an investor he is currently active in real estate, asset management and music tech. He has previously also been active in industrials and shipping.
